Terms of Service

By creating a FairSiteHQ account, running a free homepage scan, or otherwise using the service, you agree to these Terms of Service ("Terms") and to our Privacy Policy. If you're using FairSiteHQ for a company or other organization, you confirm that you have authority to bind it, and "you" means that organization throughout these Terms.

If you don't agree to these Terms, don't use FairSiteHQ.

FairSiteHQ is an automated web accessibility scanning and monitoring tool. It opens the pages of sites you submit in a real browser, runs automated checks (including the open-source axe-core engine), and reports the issues it finds, on demand or on a schedule.

FairSiteHQ is not an accessibility audit. Its results are not produced or reviewed by a credentialed accessibility professional. Automated checks find only part of the accessibility problems on a site; independent research (Deque's Automated Accessibility Coverage Report) puts the share at roughly 57%. Using FairSiteHQ doesn't guarantee that your site is accessible, that it meets the ADA, WCAG or any other law or standard, or that you won't face a legal claim. FairSiteHQ helps you find and track issues. It is not a substitute for professional review or legal advice.

Suggested code fixes in reports are examples only. Review and test them before using them on your site.

You need an account for everything except the free homepage scan. Give accurate information when you sign up and keep it current. You're responsible for activity under your account and for keeping your sign-in details secure. Tell us right away if you suspect someone else is using your account.

Free homepage scan. Anyone can scan one public homepage without an account, up to 3 times a day per visitor and 10 times a day per website. It shows issue counts and the top 3 issues explained in plain language. Before scanning, you confirm that you own the website or have permission to scan it.

Only scan sites you own or have permission to scan. Each time you add a site, run a scan or use the free homepage scan, you confirm that you own the site or that its owner has authorized you, for example as an employee, contractor or agency working for them.

What needs ownership verification. One-off manual scans of public pages don't need verification, within your plan's daily limit. Scheduled scans, email alerts and logged-in scanning need you to verify the site by adding a meta tag, an HTML file or a DNS TXT record we give you. We re-check at the start of every scheduled scan. If the proof is missing for 7 days, we pause scheduled scans, alerts and logged-in scanning for that site until it's restored. Manual scans keep working.

Agencies and prospects. You may run one-off manual scans of a prospective client's public site. Monitoring or logged-in scanning of a client's site requires the client to add the verification.

Logged-in scanning. If you give us login details for a site, you confirm that you're authorized to use them for automated testing and that doing so doesn't break that site's own terms. Use a dedicated test account where you can. The scanner fills in and submits only the login form. It doesn't submit other forms or make purchases.

How the scanner behaves. It loads pages in headless Chrome one at a time, waits for each to finish loading, and follows links on the same hostname up to your plan's page limit. It skips PDFs, images and other files. It identifies itself as FairSiteHQ-Scanner with a link to fairsitehq.com/scanner.

Requests from site owners. A site owner can ask us to block scans of their site by accounts that haven't verified ownership, and we'll do so. We may suspend or end accounts that we reasonably believe are scanning sites without permission.

Plans. FairSiteHQ offers Solo and Studio plans, billed monthly or yearly in U.S. dollars, in advance, through Stripe. Each plan's price and limits (sites, pages per scan, scan frequency, daily manual scans and how long history is kept) are shown on our pricing page when you subscribe. We'll give you reasonable notice before a price change affects your account.

Free trial. New accounts can start a 14-day free trial on Solo limits without a card. Waitlist members get 30 days. There's one trial per person, per company email domain (common webmail domains are exempt) and per website.

When a trial ends. We email you 3 days before. If you haven't added a card, your subscription pauses: you're not charged, scans and alerts stop, and your reports stay readable. Add a card at any time to continue. If you've added a card, your plan starts and you're billed.

Cancelling. Cancel at any time from the billing portal. You keep access until the end of the period you've paid for. We don't refund partial periods, except where the law requires it.

Changing plans. You can change plans from the billing portal. If you move to a plan with fewer sites or pages, your oldest sites stay active and the rest are paused, page allowances shrink to fit, and daily schedules become weekly. Nothing is deleted, and you can choose which sites stay active.

Failed payments. If a payment fails, Stripe retries it over about 7 days. If it still fails, your subscription ends: scans and alerts stop and reports become read-only.

After a trial or plan ends. Your reports stay readable for 90 days. We email you at least 14 days before that period ends, then delete your sites, scans and stored login details, as described in the Privacy Policy.

You agree not to:

• scan a site you don't own or aren't authorized to test (see section 4), or give us login details you aren't authorized to use;
• use FairSiteHQ to load-test, attack or look for security weaknesses in any site;
• get around plan limits, rate limits or the one-trial rule, for example by opening extra accounts or using several email addresses;
• interfere with or overload FairSiteHQ, or try to gain unauthorized access to it;
• resell or share access to FairSiteHQ outside your organization without our agreement;
• use FairSiteHQ to build a competing product, or scrape or reverse-engineer the service.

FairSiteHQ applies limits automatically, including each plan's site and page limits, a maximum of 25 sites per account, daily manual-scan limits, and limits on free homepage scans and ownership checks. We may suspend or end access for accounts that break these Terms.

FairSiteHQ owns the FairSiteHQ platform, including its software, design and branding. These Terms give you only the rights you need to use the service as intended.

You own your site and its content. As between you and FairSiteHQ, you also own the scan results and reports about your sites. We use them only to provide the service to you. We don't combine them with other customers' data or use them to build datasets. If we ever want to, we'll ask for your consent first.

FairSiteHQ is provided "as is" and "as available." As section 2 explains, automated scanning finds only part of a site's accessibility issues, and we don't guarantee that using FairSiteHQ will make your site accessible or compliant with any law or standard, or protect you from a legal claim. We don't promise that the service will be uninterrupted or error-free, that every issue will be detected, or that suggested fixes will work on your site.

To the fullest extent the law allows, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent the law allows, FairSiteHQ and its team won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the service.

FairSiteHQ's total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose, or US$[amount] if you've paid nothing, for example during a free trial or a free homepage scan.

You agree to indemnify and hold FairSiteHQ harmless from claims, damages and expenses (including reasonable legal fees) arising from your use of the service; from sites you submit for scanning, including any claim that you weren't authorized to scan them; from login details you give us, including any claim that you weren't authorized to use them; or from your breach of these Terms.

You can delete your account at any time from your account settings. To confirm, you type your account's email address. Deleting your account cancels any subscription first; if the subscription can't be cancelled, nothing is deleted and you can try again or contact us. Your data is then deleted as described in the Privacy Policy.

We can suspend or end your access if you break these Terms, if the law requires it, or if we discontinue the service, with reasonable notice where practical. When your access ends, your right to use FairSiteHQ ends, and your data is handled as described in the Privacy Policy.

These Terms are governed by the laws of the State of Iowa, without regard to its conflict-of-laws rules.

We may update these Terms as FairSiteHQ changes. When we do, we'll change the "last updated" date at the top. For significant changes, we'll also email active customers. If you keep using FairSiteHQ after changes take effect, you accept the updated Terms.
