Terms of Service

By creating a FairSiteHQ account or otherwise using the service, you agree to these Terms of Service ("Terms"). If you're using FairSiteHQ on behalf of a company or other organization, you're confirming that you have the authority to bind that organization, and "you" refers to that organization throughout these Terms.

If you don't agree to these Terms, don't use FairSiteHQ.

FairSiteHQ is an automated web accessibility scanning and monitoring tool. It crawls the sites you submit, runs them through axe-core — an open-source accessibility testing engine — via a real browser, and reports the issues it finds on the schedule you set.

FairSiteHQ is not a certified accessibility audit, and results are not produced or reviewed by a credentialed accessibility professional (such as a CPACC-certified reviewer) unless we explicitly tell you otherwise for a specific service. Automated scanning has real, well-documented coverage limits — independent research (Deque's Automated Accessibility Coverage Report) puts the share of real-world issues automated tools alone can catch at roughly 57%. Using FairSiteHQ does not guarantee that your site is fully accessible, that it complies with the ADA, WCAG, or any other law or standard, or that you won't face a legal claim related to accessibility. FairSiteHQ helps you find and track issues — it is not a substitute for professional review or legal advice.

You need an account to use FairSiteHQ. You agree to provide accurate information when creating your account and to keep it up to date. You're responsible for everything that happens under your account, including actions taken by anyone you've given access to it, and for keeping your login credentials secure. Let us know right away if you suspect unauthorized use of your account.

When you submit a site URL to FairSiteHQ for scanning, you represent that you own that site or are otherwise authorized to have it crawled and tested — for example, because you're an employee, contractor, or agency working on that site's owner's behalf with their permission.

FairSiteHQ is built to help you improve accessibility on sites you're responsible for. It is not a tool for probing, testing, or scanning third-party sites without authorization, and you agree not to use it that way. We may suspend or terminate accounts we reasonably believe are being used to scan unauthorized targets.

Paid plans are billed in advance on the cycle you select (for example, monthly), through our payment processor. Current plan options and pricing are described on our pricing page at the time you subscribe; we'll give you reasonable notice before any price change takes effect for your account.

You can cancel a paid plan at any time; cancellation takes effect at the end of your current billing period, and we don't provide refunds for partial periods except where required by law. If a payment fails, we may suspend access to paid features until it's resolved.

You agree not to:

• Use FairSiteHQ to scan a site you don't own or aren't authorized to test (see "Authorization to scan" above);
• Attempt to circumvent rate limits, usage caps, or scan-scheduling restrictions on your plan;
• Interfere with or overload FairSiteHQ's infrastructure, or attempt to gain unauthorized access to it;
• Resell, sublicense, or provide access to FairSiteHQ to anyone outside your organization without our agreement;
• Use FairSiteHQ to build a competing product, or to scrape or reverse-engineer the service.

We may suspend or terminate access for accounts that violate these terms.

FairSiteHQ owns the FairSiteHQ platform, including its software, design, and branding. These Terms don't grant you any rights to that beyond what's needed to use the service as intended.

You own your own site and its content. As between you and FairSiteHQ, you also own the scan data and reports FairSiteHQ generates about your sites; we use that data to provide the service to you and, in de-identified/aggregate form, to improve FairSiteHQ generally.

FairSiteHQ is provided "as is" and "as available." As described in "What FairSiteHQ is (and isn't)" above, automated scanning has real coverage limits, and we don't guarantee that using FairSiteHQ will make your site fully accessible or compliant with any law or standard, or protect you from a legal claim. FairSiteHQ doesn't warrant that the service will be uninterrupted, error-free, or that every accessibility issue on your site will be detected.

To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, FairSiteHQ and its team won't be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the service.

FairSiteHQ's total liability for any claim relating to the service is capped at the amount you paid us in the 12 months before the claim arose (or, for a free plan, a nominal amount to be set here).

You agree to indemnify and hold FairSiteHQ harmless from claims, damages, and expenses (including reasonable legal fees) arising from: your use of the service; sites you submit for scanning, including any claim that you weren't authorized to have that site scanned; or your violation of these Terms.

You can stop using FairSiteHQ and close your account at any time. We can suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the service, with reasonable notice where practical.

On termination, your right to use FairSiteHQ ends. What happens to your account data afterward is described in the Privacy Policy's data retention section.

These Terms are governed by the laws of the State of Iowa, without regard to its conflict-of-laws rules — matching where FairSiteHQ is expected to be formed as an LLC.

We may update these Terms as FairSiteHQ changes. If we make material changes, we'll update the "last updated" date at the top of this page and, for significant changes, notify active customers directly. Continuing to use FairSiteHQ after changes take effect means you accept the updated Terms.
